1. Acceptance of Terms

By accessing and using Palettt (“the Service”, “our Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Palettt is a web-based color palette generator and community platform that allows users to:

• Generate and create color palettes
• Save and organize palettes in collections
• Share palettes with the community
• Extract colors from images
• Access advanced features through Pro membership
• Follow other users and discover color palettes

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and identification
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account
• Use a valid email address that you have access to

4. Pro Membership and Payments

Pro membership provides enhanced features and capabilities. By subscribing to Pro:

• Payment processing is handled securely through Paddle
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your account settings
• No refunds are provided once payment has been processed
• Pro features remain active until the end of your billing period after cancellation
• Prices may change with 30 days advance notice to existing subscribers

5. User Content and Conduct

All color palettes, collections, and related content generated within the Service are the property of Palettt. Users are granted a non-exclusive, royalty-free license to use, export, and share palettes for personal or commercial projects. This license is limited to the palettes themselves and does not grant any rights over the Palettt platform, brand, or technology.

By using the Service, you agree not to:

• Upload, share, or use content that violates intellectual property rights
• Distribute offensive, unlawful, or harmful material through the Service
• Attempt to reverse engineer, copy, or compromise the Service’s functionality
• Use bots, scrapers, or automated tools to exploit or abuse the Service
• Impersonate others, provide false information, or misrepresent your identity
• Engage in activity that disrupts, damages, or interferes with the Service or its users

6. Intellectual Property

The Service, including its design, functionality, and underlying technology, is owned by Palettt and protected by intellectual property laws. Color palettes shared publicly become part of the community and may be used by other users for inspiration and creative purposes.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

8. Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

9. Limitation of Liability

To the fullest extent permitted by law, Palettt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising from or related to your use of the Service.

10. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately, but these Terms will remain in effect as to any prior use.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Republic of Turkey.
